Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") form a binding agreement between you and TCFCanadaPractice ("TCFCanadaPractice", "we", "us", or "our"), the operator of tcfcanadapractice.com(the "Service"). By creating an account, making a purchase, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Refund & Cancellation Policy, and Service Delivery Policy, which are incorporated here by reference. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction if higher) and legally capable of entering into a contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate and complete. The Service is intended for individual, personal exam preparation only.

3. About the Service

TCFCanadaPractice provides online practice materials for the TCF Canada examination, including reading (compréhension écrite), listening (compréhension orale), writing (expression écrite), and speaking (expression orale) practice, mock tests, model answers, useful expressions, estimated level indicators, and progress tracking.

Scores, feedback, and any estimated CLB/NCLC levels shown in the Service are approximate practice indicators generated by our own tools. They are not official results and do not predict or guarantee your performance on the official examination.

4. Accounts and registration

Some features require an account. You agree to provide accurate information, to keep it up to date, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Each account is for a single individual; you may not share, sell, or transfer your account or allow others to use it. Notify us immediately at info.tcfcanadapractice@gmail.com if you suspect unauthorised use of your account.

5. Email verification and communications

We may require you to verify your email address before your account is fully activated. By creating an account you agree to receive service-related communications from us — such as verification, password reset, purchase receipts, and important account or security notices — at the email address you provide. These are necessary to operate your account and are not marketing messages.

6. Free trial

After you create an account, the first test or prompt in each module is available free of charge so you can evaluate the Service before purchasing. We may change or withdraw the scope of the free trial at any time.

7. Pricing and payment

Premium access is sold as a one-time purchase that unlocks all premium content for a fixed access period (see Section 8). Prices are displayed at checkout in your local currency based on your location — Indian users are shown Indian Rupees (₹) and other users are shown Canadian Dollars (CA$). The price shown at checkout is the price you pay.

Payments are processed by our third-party payment provider, Razorpay. We do not receive or store your full card or bank details. By paying, you also agree to Razorpay's applicable terms. Prices are inclusive of taxes only where stated; you are responsible for any taxes, fees, or currency-conversion or bank charges that apply to your payment.

8. Access period and no auto-renewal

A successful purchase grants premium access for 30 days from the time access is granted. This is a one-time purchase: it does not auto-renew and no recurring charges are made. When the 30-day period ends, premium access stops automatically, and you may purchase again to continue. If you buy again before your current period ends, the additional 30 days are added to your remaining time.

9. Refunds and cancellation

Because access is a one-time purchase that does not auto-renew, there is nothing to cancel — access simply ends when the period expires. Refunds are handled in accordance with our Refund & Cancellation Policy.

10. Acceptable use

You agree that you will not, and will not attempt to:

  • copy, reproduce, record, download in bulk, republish, distribute, sell, sublicense, or publicly display any practice content;
  • share your account or provide access to the paid content to anyone else;
  • use any robot, scraper, crawler, or automated means to access, extract, or harvest content or data;
  • reverse engineer, decompile, or attempt to derive the source code or underlying data of the Service;
  • misuse the AI features — for example, submitting content that is not your own exam practice, that contains other people's personal data, or that is unlawful, abusive, or intended to manipulate the AI;
  • interfere with, disrupt, overload, or attempt to gain unauthorised access to the Service, its accounts, servers, or networks;
  • upload or transmit anything unlawful, infringing, malicious, or that violates the rights of others; or
  • use the Service for any unlawful purpose or in breach of these Terms.

11. Intellectual property

All content, materials, software, design, text, graphics, audio, and other elements of the Service are owned by or licensed to TCFCanadaPractice and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the content solely for your own, non-commercial exam preparation. No other rights are granted. All rights not expressly granted are reserved.

12. Your content

The Service lets you create content such as voice recordings (speaking module), written submissions (writing module), and answers. You retain ownership of your content. You grant us a limited licence to store, process, and display your content back to you for the purpose of operating the Service (for example, saving and playing back your recordings and progress). You are responsible for your content and confirm you have the right to submit it. You can delete your saved recordings and your account at any time from within the Service.

13. Third-party services

We rely on trusted third-party providers to operate the Service, including Razorpay (payments), Supabase (authentication, database, and file storage), Resend (transactional email), Google Analytics (usage analytics), and Vercel (hosting). Your use of the Service may be subject to those providers' terms, and their processing of data is described in our Privacy Policy. We are not responsible for third-party services we do not control.

14. Availability and changes to the Service

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, add, or remove features, content, or tests at any time, and may perform maintenance that temporarily limits availability. We are not liable for any unavailability, provided that if a paid feature is unavailable for a prolonged period through our fault, you may contact us about your access.

15. Disclaimers and no guarantee of results

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. TCFCanadaPractice is an independent study tool and is not affiliated with, endorsed by, or connected to the official TCF Canada examination, France Éducation international, or any government or immigration authority. We do not guarantee any particular score, level, exam result, immigration outcome, or benefit from using the Service.

AI feedback ("AI Examiner"). Some features use artificial intelligence (via OpenAI) to estimate levels and suggest corrections on your writing and speaking. AI feedback is an approximate practice aid only — it is notan official TCF Canada score, it may contain mistakes or inaccuracies, and it should not be relied upon as professional, linguistic, or immigration advice. When you use these features, the relevant text or recording is sent to our AI provider to generate the feedback (see our Privacy Policy). AI feedback is provided "as is" without warranty of accuracy.

16. Limitation of liability

To the maximum extent permitted by law, TCFCanadaPractice and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or related to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the 30 days before the event giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless TCFCanadaPractice and its operators from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party.

18. Suspension and termination

We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, or to protect the Service or other users. You may stop using the Service and delete your account at any time. Termination does not entitle you to a refund except as set out in our Refund & Cancellation Policy. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

19. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to any mandatory consumer-protection rights available to you in your country of residence, you agree that the courts of India will have jurisdiction over any dispute arising out of or relating to these Terms or the Service. Before starting any formal proceedings, you agree to first contact us at info.tcfcanadapractice@gmail.com so we can try to resolve the matter informally.

20. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above and, where appropriate, notify you. Changes take effect when posted. Your continued use of the Service after changes are posted means you accept the updated Terms.

21. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Service.
